I had forgotten some of the details of his storied career. He was drafted first overall by the Colts (who were in Baltimore at that time), refused to play for them, and forced a trade to Denver by threatening to play baseball instead.

When HOAs, courts, and rental limits collide in Douglas County

A quiet but consequential HOA fight in Douglas County highlights how much power community associations can wield, especially when state law gets involved.

Headlines like this bring back nightmares from my time dealing with LA rent control and other housing regulations. No, I do not miss it.

In the Sawgrass at Plum Creek townhome community, a new amendment now caps rentals at 25% of units, bans short-term rentals, limits owners to leasing just one property at a time, and creates a waiting list for anyone who wants to rent in the future. Existing leases are grandfathered in, and hardship exceptions may be granted, but for many owners, the change fundamentally alters what they can do with their property.

What makes this case notable is how the amendment passed. Fewer than 34% of owners voted in favor, well short of the 67% threshold outlined in the community’s covenants, which normally would have ended the proposal. But under the Colorado Common Interest Ownership Act, an HOA can petition the court for approval if more than half of the normally required votes are cast in favor. State law also requires the court to approve the amendment unless at least 33% of all owners object to it. In this case, fewer than 30 of Sawgrass’s 243 owners — about 12% — objected, leaving the judge with no legal discretion to deny the petition.

The HOA argues the rental cap protects property values, community stability, and rising insurance costs tied to higher rental concentrations. A homeowner challenging the amendment calls it draconian, saying it restricts individual rights, may force some landlords to sell, and could even depress resale values. The amendment also allows the HOA to enforce rules directly against tenants and requires higher landlord insurance coverage.

From my perspective, this raises some big questions worth watching.

  • How many homeowners truly understand that court petitions can override low turnout votes?

  • Could this become a model for other Douglas County HOAs facing insurance pressure?

  • And for buyers, sellers, and investors, how much weight should rental caps now carry when evaluating HOA communities?

Whether you love or hate HOAs, this is a reminder that the fine print and state law matter more than most people realize.
